Who you are dealing with. EarGuard is a business name registered with ASIC on the Australian Business Names Register, operated by an Australian sole trader registered in Queensland (ABN 76 335 458 075), based in Brisbane. See About EarGuard for full business details.
These terms apply when you use the EarGuard website or buy our products. By placing an order, you agree to them. Please read them alongside our Privacy Policy and Returns Policy.
1.Our products
EarGuard sells one reusable corded ear plug. It is Class 2 under AS/NZS 1270:2002, SLC(80) 14 dB, covered by StandardsMark licence SMK40540, which is held by the manufacturer. EarGuard is the Australian importer and distributor of this product and does not make it. The StandardsMark certificate (PDF) is public. In its schedule the product is listed as model EC-2062C (corded). We aim to describe our products accurately. Minor variations in colour or appearance may occur.
Important: correct use of hearing protection. Class 2 ear plugs are suited to moderate noise environments. They must be fitted correctly to perform as rated, and they are not a substitute for assessing the noise level of your own workplace. You are responsible for selecting the right class of protection for your conditions. If you are unsure, consult a qualified workplace health and safety professional. EarGuard is not liable for hearing damage resulting from incorrect product selection, fitting or use.
2.Pricing & payment
- All prices are in Australian Dollars (AUD). EarGuard is not registered for GST, so no GST is included in our prices. Every order has a printable invoice: it is shown right after purchase and linked from your order confirmation email and your order page. Need help finding it? Email orders@earguard.com.au.
- Payment is processed securely by Stripe. We accept the cards Stripe supports.
- We may update prices at any time. Changes will not affect orders already placed.
3.Orders
When you place an order, you'll receive a confirmation email. This confirms we have received your order. A contract of sale forms once we accept and dispatch it. We may decline or cancel an order (for example, if an item is unavailable or we suspect fraud), and if we do, we will refund any payment in full.
4.Shipping & delivery
We ship across Australia. Orders are usually dispatched the same or next business day, with delivery typically taking 2 to 7 business days depending on your location. Delivery timeframes are estimates and aren't guaranteed, as carrier delays can occur.
5.Returns
Returns and refunds are covered by our Returns Policy and your rights under the Australian Consumer Law.
6.Your consumer guarantees
Our products come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure, and to compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if they are not of acceptable quality and the failure does not amount to a major failure. Nothing in these terms limits those rights.
7.Limitation of liability
To the extent permitted by law, and subject to your consumer guarantees above, our liability for any claim relating to a product is limited to replacing the product or refunding its purchase price.
8.Intellectual property
The EarGuard name, logo, website content and images are owned by EarGuard and may not be copied or used without our written permission.
9.Governing law
These terms are governed by the laws of Australia, and you agree to the jurisdiction of the Australian courts.
